This privacy policy applies between you, the User of this Website and Appoyo Limited (of which ‘PaymentPlan.co.uk’ is a trading name), the owner and provider of this Website. PaymentPlan.co.uk takes the privacy of your information very seriously.

This privacy policy applies to our use of any and all Data collected by us or provided by you in relation to your use of the Website.

Definitions and interpretation

1. In this privacy policy, the following definitions are used:

Data

collectively all information that you submit to PaymentPlan.co.uk via the Website. This definition incorporates, where applicable, the definitions provided in the General Data Protection Regulation 2018 (GDPR);

a small text file placed on your computer by this Website when you visit certain parts of the Website and/or when you use certain features of the Website. Details of the cookies used by this Website are set out in the clause below (Cookies);

Client Company

A third-party firm that uses PaymentPlan.co.uk to secure payments from customers or clients who owe money to them and wish to settle this in instalments using our service.

the website that you are currently using, PaymentPlan.co.uk, and any sub-domains of this site unless expressly excluded by their own terms and conditions.

Scope of this privacy policy

3. This privacy policy applies only to the actions of PaymentPlan.co.uk, Client Companies and Users with respect to this Website. It does not extend to any websites that can be accessed from this Website including, but not limited to, any links we may provide to social media websites.

Data collected

4. User data will initially be collected by PaymentPlan.co.uk from a Client Company. The Client Company will use this data to send an invitation to create a PaymentPlan.co.uk account. During this part of the process, PaymentPlan.co.uk will act as a Data Processor, and data will not be used for any other purpose. We may collect the following Data, which includes personal Data, from you:

a) Name

b) Postal Address

c) Email address

d) Date of Birth

e) in each case, in accordance with this privacy policy.

If an email address uploaded by a Client Company is already associated with an existing PaymentPlan.co.uk account, the details uploaded will be checked against that account, and if all personal details match, the user will be invited to add a new Client Company to their list of open payment plans.

If an email address is not already associated with a PaymentPlan.co.uk account, an individual will receive an invitation to create one and become a User. If this is accepted, the User will be asked to provide the same fields of data as above, and these will be verified against the Client Company’s uploaded information to confirm it matches. Should there be any discrepancy, the Client Company will be altered (without specifically being told what piece or pieces of information do not match) and it will be necessary for them to verify their own records with a User, before a debt can be successfully uploaded to the PaymentPlan.co.uk User account.

Our use of Data

5. Once an individual has created a PaymentPlan.co.uk account and become a User, PaymentPlan.co.uk will act as a "data controller".

6. We will retain a User’s personal data if that User has an active PaymentPlan.co.uk account. Should the account be closed, for any reason, the User’s data will be retained for a period of six years after the point of closure, unless a specific request is received to purge it. If a User has ‘opted-in’ to receive direct marketing materials, then their data will be stored for the purposes of sending such materials, until such time as the business closes or the User ‘opts-out’ of receiving them.

7. Unless we are obliged or permitted by law to do so, and subject to any third-party disclosures specifically set out in this policy, your Data will only be shared with named third-party groups. PaymentPlan.co.uk will share data with the Client Businesses a User has set up a payment plan with.

Other third-parties will also be used, and User data will be shared with these, for the purpose of conducting PaymentPlan.co.uk’s service. Payment data will be shared with Stripe for the purposes of carrying out card transactions. All data relating to card payments, including credit or debit card data is stored in Stripe’s secured servers. PaymentPlan.co.uk does not store any payment information within its own servers, and all transactions are conducted by Stripe, with money paid directly to the Client Business’ Stripe account.

PaymentPlan.co.uk may use other third-party services to make contact with a User. These include the email client MailChimp, which is a trading name of The Rocket Science Group, and SMS service FireText, which is a trading name of FireText Communications Ltd.

PaymentPlan.co.uk utilises the Microsoft Azure hosting service for its website and applications. Personal data will be stored on Microsoft servers, located in the European Union.

8. All personal Data is stored securely in accordance with the principles of the GDPR. For more details on security see the clause below (Security).

9. Any or all of the above Data may be required by us from time to time in order to provide you with the best possible service and experience when using our Website. Specifically, Data may be used by us for the following reasons:

a. internal record keeping;

b. improvement of our products / services;

c. transmission by email of promotional materials that may be of interest to you (with your consent);

d. contact for market research purposes which may be done using email, telephone, fax or mail. Such information may be used to customise or update the Website;

in each case, in accordance with this privacy policy.

Third party websites and services

10. PaymentPlan.co.uk may, from time to time, employ the services of other parties for dealing with certain processes necessary for the operation of the Website. The providers of such services do not have access to certain personal Data provided by Users of this Website.

11. This Website may, from time to time, provide links to other websites. We have no control over such websites and are not responsible for the content of these websites. This privacy policy does not extend to your use of such websites. You are advised to read the privacy policy or statement of other websites prior to using them.

Changes of business ownership and control

12. PaymentPlan.co.uk may, from time to time, expand or reduce our business and this may involve the sale and/or the transfer of control of all or part of PaymentPlan.co.uk. Data provided by Users will, where it is relevant to any part of our business so transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this privacy policy, be permitted to use the Data for the purposes for which it was originally supplied to us.

36. PaymentPlan.co.uk reserves the right to change this privacy policy as we may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on the Website and you are deemed to have accepted the terms of the privacy policy on your first use of the Website following the alterations.

Your rights

37. In addition to your rights to access and restrict the use of your Personal Data, you can also request to have this restricted, rectified, object to processing, or to have your data erased. If consent is the basis of processing of your data, them PaymentPlan.co.uk will comply with this request and remove all Personal Data from our databases. However, if there is another legal basis for processing your data, we will clarify what data has been retained and the reasons for this.

In instances where a data subject exercises their right to erasure, and the business has no other legal basis to process the data, the request will be conducted, but the business will retain a small amount of personal data in a log of erased files.
